*மாண்புமிகு ஒன்றிய உள்துறை அமைச்சர் திரு.அமித்ஷா அவர்களால் இன்று தாக்கல் செய்யப்பட்டுள்ள 130 வது அரசியலமைப்புத் திருத்த மசோதா இந்தியாவை ஒரு சர்வாதிகார நாடாக மாற்றுவதற்கான சதித்திட்டத்தின் ஓர் அங்கம் என்பது தெளிவாகத் தெரிகிறது.
இத்தகைய நகர்வுகள் ஜெர்மனியில் அடால்ப் ஹிட்லர் மேற்கொண்ட நடவடிக்கைகளையே பிரதிபலிக்கிறது. அவரும் அதிகாரத்தைக் கைப்பற்றி 1933 ம் ஆண்டு இயற்றிய சட்டத்தின் மூலம் ஜெர்மனியின் அரசியலமைப்பையே அழித்தார் என்பதை நினைவில் கொள்ள வேண்டும்.
சட்டத்தின் ஆட்சியை பின்பற்றும் எந்தவொரு ஜனநாயக நாடும், ஒருவர் குற்றவாளி என்று நிரூபிக்கப்படும் வரை அவர் நிரபராதி என்கிற அடிப்படை கோட்பாட்டைப் பின்பற்ற வேண்டியது அவசியம். ஒரு வழக்கு பதிவு செய்யப்படுவதாலோ, ஒன்றிய அரசின் உத்தரவுக்கிணங்க செயல்படும் ஒன்றிய அமைப்புகள் ஒருவரை கைது செய்வதாலோ மட்டுமே அவர் குற்றவாளி ஆகிவிட முடியாது.
தனது அரசியல் எதிரிகள் மீது போலி வழக்குகளைப் பதிவு செய்து அவர்களை கைது செய்வதற்காக சிபிஐ மற்றும் அமலாக்கத்துறை போன்றவை பாஜக அரசால் எவ்வாறு பயன்படுத்தப்பட்டது என்பதன் அடிப்படையில் இன்று முன்மொழியப்பட்டுள்ள திருத்தச் சட்டமானது பார்க்கப்பட வேண்டும்.
பாஜக-வின் அரசியல் எதிரிகளுக்கு எதிராக அமலாக்கத்துறை பதிவு செய்த 193 வழக்குகளில் வெறும் இரண்டில் மட்டுமே தண்டனை பெற்றுத்தரப்பட்டுள்ளது. மீதமுள்ள 191 வழக்குகள் அரசியல் நோக்கத்திற்காக பொய்யாக சுமத்தப்பட்டவை என்பது தெளிவாகிறது.
ஆம் ஆத்மி கட்சியை சார்ந்த ஸ்ரீ சத்யேந்திர ஜெயின் அவர்களை இதற்கு ஒரு சிறந்த உதாரணமாக எடுத்துக்கொள்ளலாம். அவர் அமலாக்கத்துறையினால் கைது செய்யப்பட்டார்.. ஆனால் இறுதியில் அவருக்கு எதிரான அந்த வழக்கை முடித்து வைக்கும் அறிக்கையை சிபிஐ தாக்கல் செய்துள்ளது.
தனது அரசியல் எதிரிகளை கைது செய்வதன் மூலம் அவர்களை அச்சுறுத்தும் முயற்சியில் விரும்பிய விளைவுகளை பாஜகவினால் அடைய முடியாத காரணத்தால் தற்போது மக்களால் தேர்ந்தெடுக்கப்பட்ட மாநில முதலமைச்சர்கள் மற்றும் அமைச்சர்களையே கைது செய்து பதவியிலிருந்து நீக்க பாஜக முயல்கிறது.
இது முற்றிலும் அதிகாரப் பறிப்பு என்பதோடு, ஒன்றியம் மற்றும் மாநிலங்களுக்கு இடையிலான அரசியலமைப்பு அதிகாரப் பகிர்வை அதாவது நாம் கூட்டாட்சி அமைப்பு என்று அழைக்கும் கட்டமைப்பையே சீர்குலைக்கும் முயற்சியாகும். மக்களால் தேர்ந்தெடுக்கப்பட்ட ஒரு மாநில முதலமைச்சரையே ஒன்றிய அரசானது பதவி நீக்கம் செய்யுமென்றால், இது ஜனநாயகத்திற்கே சாவுமணி அடிப்பதன்றி வேறில்லை..
இந்த மசோதாவில் பிரதமரும் சேர்க்கப்பட்டுள்ளார் என்ற மேலோட்டமான வாதத்தை யாரும் ஏற்றுக்கொள்ள மாட்டார்கள்.
ஒரு பிரதமரை கைது செய்ய வேண்டுமென்றால் அதற்கு ( பிரதமர் தலைமை வகிக்கும் ஒன்றிய அமைச்சரவையின் பரிந்துரையின் பேரில் ) குடியரசுத் தலைவர் அவர்கள் ஒப்புதல் அளிக்க வேண்டும்.
ஒரு மாநில முதலமைச்சர் அல்லது அமைச்சர் தொடர்பான விவகாரத்தில், மாநில அமைச்சரவையின் உதவி அல்லது ஆலோசனையின் பேரில் ஆளுநர்தான் ஒப்புதல் அளிக்க வேண்டுமென்றாலும், பாஜக அரசால் நியமிக்கப்பட்டுள்ள பல ஆளுநர்கள் மாநில அமைச்சரவைக்கு எதிராகவும் – ஒன்றிய அரசின் கட்டளைப்படியும் எவ்வாறு செயல்படுகிறார்கள் என்பதை நாம் பார்த்து வருகிறோம்.
எப்பொழுதெல்லாம் ஒரு வலுவான பிராந்தியத் தலைவர் பிரதமரை எதிர்க்கிறாரோ, அப்போதே ஒரு போலி வழக்கை சுமத்தி, அமலாக்கத்துறை அல்லது சிபிஐ மூலம் கைது செய்து, அவரை முதலமைச்சர் / அமைச்சர் பதவியிலிருந்து நீக்குவது எனும் இந்த சதிவலை அனைவருக்கும் தெளிவாகத் தெரிகிறது.
தேர்தல் ஆணையத்தில் பாஜக ஊடுருவி முன்னெப்போதும் இல்லாத வகையில் வாக்கு மோசடியில் ஈடுபட்டு அம்பலமானதை கருத்தில் எடுத்துக்கொண்டு பார்த்தால், இந்தியாவின் ஜனநாயக அடித்தளங்களை சிதைக்கும் ஒரு மிகப் பெரிய திட்டமே இங்கு அரங்கேற்றப்படுகிறது என்பது வெட்ட வெளிச்சமாகிறது.
மேலும், இந்த 130 வது அரசியலமைப்பு திருத்த மசோதா தாக்கல் செய்யப்பட்டிருப்பது, தேசிய ஜனநாயக கூட்டணியில் இருந்துகொண்டு மாநிலங்களில் ஆட்சி செய்யும் பாஜக-வின் கூட்டணிக் கட்சிகளை அச்சுறுத்த வீசப்படும் கத்தி என்பதையும் நான் உணருகிறேன். தேசிய ஜனநாயக கூட்டணியில் உள்ள பெரும்பாலான பிராந்திய கட்சிகள் கூட, பாஜக அரசியலமைப்பை சிதைப்பதைக் கண்டு அதிருப்தி அடைந்துள்ளன. இதன் காரணமாக குடியரசுத்
துணைத் தலைவர் தேர்தல் குறித்தும் கூட, தேசிய ஜனநாயக கூட்டணிக் கட்சிகளுக்குள் சில முரண்பட்ட குரல்கள் எழுந்திருக்கின்றன என்பதில் ஆச்சரியம் ஏதுமில்லை.
இத்தகைய சர்வாதிகாரப் போக்கானது பிரிட்டிஷ் ஆட்சிக்காலத்தில் நாம் கண்டதை விட மோசமானதாகும்.
பாஜக- விடம் இருந்து நமது அரசியலமைப்பையும், நாட்டையும், ஜனநாயகத்தையும் காப்பதற்காக நாம் அனைவரும் ஒன்றிணைய வேண்டிய தருணம் இதுவாகும்.
The 130th Constitution Amendment Bill moved by Home Minister Amit Shah is clearly part of a diabolical plan to turn Indian into a dictatorship. These moves mirror the moves made by Adofl Hitler in Germany. Remember, he too seized power and destroyed Germany’s constitution by enacting a law – the Enabling Act of 1933.
Any civilized democracy following rule of law has to follow a fundamental doctrine – a person is innocent unless proven guilty. Mere registration of a case and arrest by central agencies acting under dictates of the Union Government does not render a person “guilty”.
This proposed amendment has to be seen in the backdrop of how the ED and CBI has been used to foist false cases against political opponents and arrest them. Out of 193 cases registered by ED against political rivals of the BJP, only 2 have ended in conviction, proving that 191 cases are false and foisted for political reasons. See the classic example of Shri Satyendra Jain of AAP – after much ado, the CBI itself has filed a closure report in a case against him, after arresting him and unleashing the ED.
Now since the BJP has not been able to achieve the desired effect of browbeating the political opponents with arrest, they want to remove elected State Chief Ministers and Ministers by arresting them. This is pure power grab and an attempt to defile the constitutional separation of powers between Union and States – what we call the federal structure. It also sounds a death knell to democracy as the Union can unseat elected State CMs.
Nobody is falling for the shallow argument that the PM has also been included in this Bill. For the PM to be arrested, the sanction has to be given by the President (on the advice of the Union Cabinet headed by the PM). For a State CM or Minister, though the sanction has to be given by the Governor acting under the aid and advice of the State Cabinet, we have seen many BJP appointed Governors acting against the State Caninet’s advice & following the diktat of the Union Government.
So the “sketch” is obvious for everyone to see – whenever a strong regional leader opposes the PM, foist a false case, arrest them with ED or CBI and remove them as CM/ Minister.
When viewed alongside the recent expose of how the Election Commission has been infiltrated by the BJP and used to indulge in massive voter fraud at an unprecedented scale, we can see that there is a larger plan at play here to shatter India’s democratic foundations.
I feel that this move is also BJP flashing the knife at its own allies within the NDA who are heading Governments at the State level. Probably many regional party NDA allies are unhappy at the way the BJP is dismantling the constitution. One wonders whether there were also some discordant voices among the NDA allies about the VP elections.
This kind of authoritarianism is worse than what we witnessed under the British. It’s time for all to unite to achieve freedom from the BJP – to save our Constitution, Country and Democracy!
